2. Collection and storage of personal data and the manner and purpose of its use
a) When visiting the website
When you visit our website www.ticwave.com, the browser you are using on your device will automatically send data to the servers on which our website is hosted. This data is stored temporarily in a log file. The following data are collected, without any action on your part, and stored until it is automatically deleted:
- IP address of the querying computer,
- date and time of access,
- name and URL of the file requested,
- website from which access is made (referrer URL),
- browser used and possibly the operating system of your computer, as well as the name of your access provider.
We will process the above mentioned data for the following purposes only:
- ensuring a smooth connection is established to the website,
- ensuring a comfortable user experience on our website,
- assessing the system security and stability, and
- for other administrative purposes.
The basis for lawful processing of data is laid out in Article 6(1) Point (f) of the General Data Protection Regulation (GDPR) of the European Union. The data collection purposes listed above constitute our legitimate interest. In no case do we use the collected data for the purpose of profiling your person.
Furthermore, we use cookies and analytical services for visits to our website. More detailed explanations on this are given in Points 4 and 5 of this Privacy Policy.
b) When subscribing to our newsletter
Provided you have given your consent in accordance with Article 6(1) Point (a) of the GDPR, we will use your email address to send our newsletter regularly to you. To receive our newsletter, you only need to provide an email.
You can unsubscribe at any time, for example by following the link at the end of each newsletter. Alternatively, you can express your wish to unsubscribe at any time by sending an email to contact@ticwave.com.
c) When using our contact form
For enquiries of any kind, you can make use of the contact form provided on our website. To use this form, you do need to provide an email address so that we know who is making the enquiry and so that we can send you our reply. Any other information is provided voluntarily.
We process data provided for the purpose of establishing contact in accordance with Article 6(1) Point (a) of the GDPR, based on your freely given consent.
The personal data we collect for the use of our contact form will be automatically deleted after the services in answer to your enquiry have ended.
3. Disclosure of data
We will not disclose your personal data to third parties for any purposes other than those listed below.
We will only disclose your personal data to third parties if:
- you have given your explicit consent, in accordance with Article 6(1) Point (a) of the GDPR,
- it is necessary to disclose this data, in accordance with Article 6(1) Point (f) of the GDPR, for the establishment, exercise or defence of legal claims, and no grounds exist to assume you have an overriding and legitimate interest in the nondisclosure of your data,
- for compliance with a legal obligation to disclosure in accordance with Article 6(1) Point (c) of the GDPR, and
- it is legally permitted and necessary for the performance of a contract with you in accordance with Article 6(1) Point (b) of the GDPR.
4. Cookies
We use cookies on our site. These are small files that your browser automatically creates and stores on your local device (laptop, tablet, smartphone or other) when you visit our site. Cookies contain no viruses, trojans or other malware and cannot harm your computer.
A cookie is used to store data that arises in connection with the specific device used. This does not mean, however, that we can in any way identify you directly from this data.
The use of cookies serves to make our services more convenient for you. We employ session cookies to know when you have already visited certain pages of our websites, for example. These session cookies will be automatically deleted as soon as you leave our site.
Furthermore, we set temporary cookies, also for the purpose of optimising user friendliness, that are stored on your device for a certain, specified period of time. The next time you visit our website to make use of our services, it will be automatically recognised that you have already visited us, and what input and settings you made, so that you do not need to make them again.
We also use cookies in order to collect statistics on the use of our website and to analyse this use for the purpose of optimising our services for you (see Point 5). These cookies allow us to automatically recognise that you have visited us upon your next visit. These cookies will each be automatically deleted after a set period of time.
The data processed through cookies are necessary for the abovementioned purposes for the protection of our legitimate interests and those of third parties in accordance with Article 6(1) Point (f) of the GDPR.
Most browsers accept cookies automatically. You can, however, configure your browser so that it will not store any cookies on your computer, or to provide a warning before any new cookie is set. Completely disabling cookies, however, can result in you being unable to use all functions of our website.
5. Analytical tools
a) Tracking tools
The following tracking measures we employ are taken on the basis of Article 6(1) Point (f) of the GDPR. We employ these tracking measures to ensure the user-oriented design and continual optimisation of our website. We also use these tracking measures to collect statistics on the use of our website and to analyse this use for the purpose of optimising our services for you. These interests are legitimate in the sense of the abovementioned regulation.
The respective data processing purposes and data categories are described separately for each tool.
i) Google Analytics1
For the user-oriented design and continual optimisation of our web pages, we use Google Analytics, a web analysis service provided by Google Inc.(https://www.google.de/intl/de/about/),1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). In this context, pseudonymised user profiles are created and cookies are used (see Point 4). The information produced in the cookie regarding your use of this website, such as the
- browser type and version,
- operating system used,
- referrer URL (previously visited site),
- hostname of the accessing computer (IP address), and
- time of the server request,
is sent to a Google server in the USA and stored there. This information will be used for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and Internet usage for the purposes of market research and user-oriented design of these web pages. This information is also transferred to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Your IP address will never be associated with any other data held by Google. IP addresses are anonymised so that they cannot be traced back to the users (IP masking).
You can prevent the installation of cookies on your computer by setting your browser accordingly; however, we must point out that in this case not all functions of the website will be available to you in their full capacity.
You can also prevent Google’s recording of the cookie-generated data regarding your use of the website (including your IP address) and prevent Google’s processing of this data by downloading and installing the browser add-onavailable at the link(https://tools.google.com/dlpage/gaoptout?hl=en).
Alternatively to this add-on, especially when browsing on mobile devices, you can also prevent Google Analytics from tracking your data by clicking the following link. This will set an opt-out cookie that prevents the collection of your data on future visits to this website. The opt-out cookie only applies to the browser you are currently using and only for our website, and is stored on your device. If you delete the cookies from this browser, then you will have to reset the opt-out cookie.

ii) Google Adwords conversion tracking
In order to statistically analyse the use of our website and for the purpose of optimising our website for you, we also use Google Conversion Tracking. This means Google Adwords will create a cookie (see Point 4) on your computer if you were brought to our website from a Google ad.
These cookies expire after 30 days and cannot be used to identify a person. If the user visits certain pages on the website of an Adwords customer, and the cookie has not yet expired, then Google and the customer can recognise when a user has clicked on an ad and been forwarded to a specific page.
Every Adwords customer receives a different cookie. Cookies can therefore not be traced through the websites of Adwords customers. The information collected by the conversion cookie serves to create conversion statistics for Adwords customers who have opted into conversion tracking. These Adwords customers learn of the total number of users who have clicked their ad and been forwarded to a page that bears a conversion tracking tag. However, they do not receive any information by which they could personally identify a user.
If you do not wish to participate in tracking, you can block the cookie used for tracking – for example with a browser setting that disables cookies entirely. You can also disable conversion tracking cookies by setting your browser to block cookies from the domain “www.googleadservices.com”. iii) Matomo
We use the open-source software Matomo for analysing and statistically evaluating the use of our website. Cookies are set for this purpose (see Point 4). The information created about use of the website and stored in the cookie is sent to our servers and consolidated in pseudonymous user profiles. This information is used to analyse the use of our website and to allow user-oriented design of our website. This information will not be forwarded to third parties.
The IP address is never associated with other data relating to the user. IP addresses are anonymised so that they cannot be traced back to the users (IP masking).

6. Social media plug-ins
In line with the principles of Article 6(1) Point (f) of the GDPR, we use the social plug-ins of the social media Facebook, Twitter and Instagram as a means of publicity for our company. The promotional purpose behind this is a legitimate interest in the sense of the GDPR. The respective service providers are responsible for operating their services in compliance with data protection interests and regulations. For the best possible protection of visitors to our website, we have integrated these plug-ins using the two-click method.
a) Facebook
Our website uses social media plugins from Facebook as a way to personalise the visiting experience. For this, we use the “LIKE” or “SHARE” buttons that are provided as a service by Facebook.
When you visit a page on our website that contains such a plugin, your browser establishes a direct connection with the Facebook servers. The contents of the plugin are transmitted directly from Facebook to your browser and integrated by your browser into the website.
Because this plugin is integrated, Facebook learns that your browser has called up the corresponding page on our website, even if you do not have a Facebook account or are not currently logged into Facebook. This information (which includes your IP address) is transmitted directly by your browser to a Facebook server in the USA, and stored there.
If you are currently logged into Facebook, then Facebook can trace the visit to our website directly back to your Facebook account. If you interact with these plugins, for example if you click the “LIKE” or “SHARE” button, then the corresponding information will also be transmitted to and stored on a Facebook server. This information will also be published on Facebook and made visible to your Facebook friends.
Facebook can use this information for the purposes of advertising, market research and user-oriented design of Facebook pages. Particularly, Facebook will create usage, interest and relationship profiles, for example, to analyse your use of our websites in relation to the ads shown on your Facebook page, to inform other Facebook users of your activity on our website, and to provide other services related to the use of Facebook.
If you do not wish for Facebook to associate the data collected from visiting our website to your Facebook account, you must log out of your Facebook account before visiting our site.

b) Twitter
The pages on our website integrate plugins from the short message network Twitter Inc. (“Twitter”). You can recognise that Twitter plugins (tweet button) are used from the Twitter logo on our site. You can learn more about tweet buttons here(https://about.twitter.com/resources/buttons).
When you visit a page on our website that contains such a plugin, a direct connection will be established between your browser and a Twitter server. Twitter thus learns that you, at your IP address, have visited our site. When you click on a “tweet button” while you are logged into your Twitter account, then you can link the content of our site to your Twitter profile. This way, Twitter can trace your visit to our site to your user account. Please note that, as the website provider, we have no knowledge of the content of the data transmitted or of how Twitter uses that data.

c) Instagram
Our website also uses the social plugins (“plugins”) of Instagram, as operated by Instagram LLC., 1601 Willow Road, Menlo Park, CA 94025, USA (“Instagram”).
These plugins can be recognised from an Instagram logo, for example in the form of an “Instagram camera”.
When you visit a page on our website that contains such a plugin, your browser establishes a direct connection with the Instagram servers. The contents of the plugin are transmitted directly from Instagram to your browser and integrated into the web page. Because of this integration, Instagram learns that your browser has called up the corresponding page on our website, even if you do not have an Instagram profile or are not currently logged into Instagram.
This information (which includes your IP address) is transmitted directly by your browser to an Instagram server in the USA, and stored there. If you are currently logged into Instagram, then Instagram can trace the visit to our webpage directly back to your Instagram account. If you interact with these plugins, for example if you click the “Instagram” button, then the corresponding information will also be transmitted to and stored on an Instagram server.
This information will also be published on your Instagram account and made visible to your contacts.
If you do not wish for Instagram to associate the data collected from visiting our website directly to your Instagram account, you must log out of your Facebook account before visiting our site.

7. Rights of the data subject
You have the right:
- according to Article 15 of the GDPR to request information regarding your personal data that we process. In particular, you can obtain information about the purposes of the processing; the categories of personal data concerned; the recipients or categories of recipient to whom the personal data have been or will be disclosed; the envisaged period for which the personal data will be stored; the existence of the right to request rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing; the right to lodge a complaint with a supervisory authority; information as to the source of any data that was not collected by us; the existence of automated decision-making, including profiling, and, if applicable, meaningful information as to their details.
- according to Article 16 of the GDPR to request the rectification of inaccurate or completion of incomplete data concerning you that we have stored.
- according to Article 17 of the GDPR to obtain from us the erasure of personal data concerning you without undue delay provided the processing is no longer necessary for exercising the right of free expression and information; for compliance with a legal obligation; for reasons for public interest; or for the establishment, exercise or defence of legal claims;
- according to Article 18 of the GDPR to obtain from us the restriction of processing of your personal data provided you contest the accuracy of the personal data; the processing is unlawful but that you oppose the erasure and we no longer require the data but you still require them for the establishment, exercise or defence of legal claims; or you have objected to its processing pursuant to Article 21 of the GDPR;
- according to Article 20 of the GDPR to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format, and have the right to transmit those data to another controller;
- according to Article 7(3) of the GDPR to withdraw at any time any consent you have given us. This will result in us being unable to continue any future data processing based on this consent; and
- according to Article 77 of the GDPR to lodge a complaint with a supervisory authority. As a rule, you can refer to the authority in your normal place of residence, of your workplace, or of our location for this purpose.
8. Right to object
According to Article 21 of the GDPR, you have the right to object at any time to any processing of your personal data which is based on legitimate interests according to Article 6(1) Point (f) of the GDPR, provided grounds exist relating to your particular situation or if the objection is to direct marketing. In the latter case, you have a general right to object, which we shall respect without you having to specify any particular situation.

9. Data security
For the security of visits to our website, we employ the widely used SSL (Secure Socket Layer) method in conjunction with the highest encryption level that your browser supports. In most cases, this is 256-bit encryption. If your browser does not support 256-bit encryption, then we will fall back on 128-bit v3 technology. Which of the pages on our website are transferred in encrypted form can be recognised by a symbol of a key or of a closed padlock in the address bar or in the lower status bar of your browser.
We also employ suitable technical and organisational security measures in order to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or access by unauthorised third parties. Our security measures are continually improved to reflect technological progress.

This Privacy Policy is currently valid, as of its last revision in May 2018.

Mit den nachfolgenden Hinweisen klären wir Sie über die Inhalte unseres Newsletters sowie das Anmelde-, Versand- und das statistische Auswertungsverfahren sowie Ihre Widerspruchsrechte auf. Indem Sie unseren Newsletter abonnieren, erklären Sie sich mit dem Empfang und den beschriebenen Verfahren einverstanden.
Inhalt des Newsletters
Wir versenden Newsletter, E-Mails und weitere elektronische Benachrichtigungen mit werblichen Informationen (nachfolgend „Newsletter“) nur mit der Einwilligung der Empfänger oder einer gesetzlichen Erlaubnis. Sofern im Rahmen einer Anmeldung zum Newsletter dessen Inhalte konkret umschrieben werden, sind sie für die Einwilligung der Nutzer maßgeblich. Im Übrigen enthalten unsere Newsletter Informationen über unsere Indikationsbereiche, unser Produktportfolie sowie damit in Zusammenhang stehende Branchennews (hierzu können insbesondere Hinweise auf Blogbeiträge, Vorträge oder Workshops, unsere Leistungen oder Onlineauftritte gehören).
Double-Opt-In und Protokollierung
Die Anmeldung zu unserem Newsletter erfolgt in einem sog. Double-Opt-In-Verfahren. D.h. Sie erhalten nach der Anmeldung eine E-Mail, in der Sie um die Bestätigung Ihrer Anmeldung gebeten werden. Diese Bestätigung ist notwendig, damit sich niemand mit fremden E-Mailadressen anmelden kann.
Die Anmeldungen zum Newsletter werden protokolliert, um den Anmeldeprozess entsprechend den rechtlichen Anforderungen nachweisen zu können. Hierzu gehört die Speicherung des Anmelde- und des Bestätigungszeitpunkts, als auch der IP-Adresse. Ebenso werden die Änderungen Ihrer bei MailChimp gespeicherten Daten protokolliert.
Einsatz des Versanddienstleisters „MailChimp“
Der Versand der Newsletter erfolgt mittels „MailChimp“, einer Newsletterversandplattform des US-Anbieters Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.
Die E-Mail-Adressen unserer Newsletterempfänger, als auch deren weitere, im Rahmen dieser Hinweise beschriebenen Daten, werden auf den Servern von MailChimp in den USA gespeichert. MailChimp verwendet diese Informationen zum Versand und zur Auswertung der Newsletter in unserem Auftrag. Des Weiteren kann MailChimp nach eigenen Informationen diese Daten zur Optimierung oder Verbesserung der eigenen Services nutzen, z.B. zur technischen Optimierung des Versandes und der Darstellung der Newsletter oder für wirtschaftliche Zwecke, um zu bestimmen aus welchen Ländern die Empfänger kommen. MailChimp nutzt die Daten unserer Newsletterempfänger jedoch nicht, um diese selbst anzuschreiben oder an Dritte weiterzugeben.
Wir vertrauen auf die Zuverlässigkeit und die IT- sowie Datensicherheit von MailChimp. MailChimp ist unter dem US-EU-Datenschutzabkommen „Privacy Shield“ zertifiziert und verpflichtet sich damit die EU-Datenschutzvorgaben einzuhalten. Des Weiteren haben wir mit MailChimp ein „Data-Processing-Agreement“ abgeschlossen. Dabei handelt es sich um einen Vertrag, in dem sich MailChimp dazu verpflichtet, die Daten unserer Nutzer zu schützen, entsprechend dessen Datenschutzbestimmungen in unserem Auftrag zu verarbeiten und insbesondere nicht an Dritte weiter zu geben. Anmeldedaten
Um sich für den Newsletter anzumelden, reicht es aus, wenn Sie Ihre E-Mailadresse angeben.
Optional bitten wir Sie Ihren Vor- und Nachnamen anzugeben. Diese Angaben dienen lediglich der Personalisierung des Newsletters.
Statistische Erhebung und Analysen
Die Newsletter enthalten einen sog. „web-beacon“, d.h. eine pixelgroße Datei, die beim Öffnen des Newsletters von dem Server von MailChimp abgerufen wird. Im Rahmen dieses Abrufs werden zunächst technische Informationen, wie Informationen zum Browser und Ihrem System, als auch Ihre IP-Adresse und Zeitpunkt des Abrufs erhoben. Diese Informationen werden zur technischen Verbesserung der Services anhand der technischen Daten oder der Zielgruppen und ihres Leseverhaltens anhand derer Abruforte (die mit Hilfe der IP-Adresse bestimmbar sind) oder der Zugriffszeiten genutzt.
Zu den statistischen Erhebungen gehört ebenfalls die Feststellung, ob die Newsletter geöffnet werden, wann sie geöffnet werden und welche Links geklickt werden. Diese Informationen können aus technischen Gründen zwar den einzelnen Newsletterempfängern zugeordnet werden. Es ist jedoch weder unser Bestreben, noch das von MailChimp, einzelne Nutzer zu beobachten. Die Auswertungen dienen uns viel mehr dazu, die Lesegewohnheiten unserer Nutzer zu erkennen und unsere Inhalte auf sie anzupassen oder unterschiedliche Inhalte entsprechend den Interessen unserer Nutzer zu versenden.
Online-Aufruf und Datenmanagement
Es gibt Fälle, in denen wir die Newsletterempfänger auf die Webseiten von MailChimp leiten. Z.B. enthalten unsere Newsletter einen Link, mit dem die Newsletterempfänger die Newsletter online abrufen können (z.B. bei Darstellungsproblemen im E-Mailprogramm). Ferner können Newsletterempfänger ihre Daten, wie z.B. die E-Mailadresse nachträglich korrigieren. Ebenso ist die Datenschutzerklärung von MailChimp nur auf deren Seite abrufbar.
In diesem Zusammenhang wiesen wir darauf hin, dass auf den Webseiten von MailChimp Cookies eingesetzt und damit personenbezogene Daten durch MailChimp, deren Partnern und eingesetzten Dienstleistern (z.B. Google Analytics) verarbeitet werden. Auf diese Datenerhebung haben wir keinen Einfluss. Weitere Informationen können Sie der Datenschutzerklärung von MailChimp entnehmen. Wir weisen Sie zusätzlich auf die Widerspruchsmöglichkeiten in die Datenerhebung zu Werbezwecken auf den Webseiten http://www.aboutads.info/choices/ und http://www.youronlinechoices.com/ (für den Europäischen Raum) hin.
Kündigung/Widerruf
Sie können den Empfang unseres Newsletters jederzeit kündigen, d.h. Ihre Einwilligungen widerrufen. Damit erlöschen gleichzeitig Ihre Einwilligungen in dessen Versand via MailChimp und die statistischen Analysen. Ein getrennter Widerruf des Versandes via MailChimp oder der statistischen Auswertung ist leider nicht möglich.

Rechtsgrundlagen Datenschutzgrundverordnung
Entsprechend den Vorgaben der ab dem 25. Mai 2018 geltenden Datenschutzgrundverordnung (DSGVO) informieren wir Sie, dass die Einwilligungen in den Versand der E-Mailadressen auf Grundlage der Art. 6 Abs. 1 lit. a, 7 DSGVO sowie § 7 Abs. 2 Nr. 3, bzw. Abs. 3 UWG erfolgt. Der Einsatz des Versanddienstleisters MailChimp, Durchführung der statistischen Erhebungen und Analysen sowie Protokollierung des Anmeldeverfahrens, erfolgen auf Grundlage unserer berechtigten Interessen gem. Art. 6 Abs. 1 lit. f DSGVO. Unser Interesse richtet sich auf den Einsatz eines nutzerfreundlichen sowie sicheren Newslettersystems, das sowohl unseren geschäftlichen Interessen dient, als auch den Erwartungen der Nutzer entspricht.
Wir weisen Sie ferner darauf hin, dass Sie der künftigen Verarbeitung Ihrer personenbezogenen Daten entsprechend den gesetzlichen Vorgaben gem. Art. 21 DSGVO jederzeit widersprechen können. Der Widerspruch kann insbesondere gegen die Verarbeitung für Zwecke der Direktwerbung erfolgen.
